What is a medical negligence claim?
Medical Negligence claims in Queensland are regulated by the provisions of the Personal Injuries Proceedings Act 2002 (PIPA). These claims can be quite complex and, in order to be successful, require the skill and expertise of a practitioner experienced in pursuing medical malpractice claims. It is vital that the Medical Negligence Lawyer that takes on your case is specialised in this area. Too many times, people that have suffered injury from malpractice have not had representation from a sufficiently experienced malpractice lawyer. Their claim has either not received the compensation they deserve, they have lost their claim, or it has dragged on for far too long.
Achieve not only the maximum compensation but also justice for the wrong you have suffered.

Prescribing incorrect medication
Failure to provide the appropriate treatment
Delay in providing the appropriate treatment
Failure to treat at all
Failure to provide a referral to a specialist
Failure to properly investigate
Failure to provide appropriate post operative care
How can I make a medical negligence claim?
Our Medical Negligence lawyers have access to the relevant medical professionals that are willing and are qualified to provide such opinion. To make a claim for medical negligence compensation, you will need to establish that:
- There was a failure of the medical treatment provider to provide an adequate standard of care, and
- As a result of the failure, you have suffered a personal injury.
You will require an expert opinion from a medical practitioner establishing or confirming the negligence of the medical treatment provider. Furthermore, describing or diagnosing the damage caused by the negligence and differentiating the extent of injury, loss or damage caused by the negligence over and above that which was already being suffered prior to the negligence.
How long do I have to make medical negligence claims?
There are very strict time limits within which you must take steps to protect your interests and ability to bring a claim for compensation. For instance:
Pursuant to PIPA, you must deliver an Initial Notice within nine (9) months from the date of the medical incident or from the date that you first noticed symptoms of the injury
You must commence court proceedings against the negligent treatment provider within three (3) years from the date of the medical incident, failing which any claim for compensation that you might have otherwise had will be forever statute barred
