Even passengers on public transport are entitled to file motor vehicle accident claims.
If the vehicle at fault is identified, an accident claim can be made against that vehicle’s compulsory Third Party (CTP) insurer. Our car accident lawyers are here to help if you need someone to guide you along the way. For injuries sustained in a road accident, you generally have only 9 months from the date of the accident to lodge a claim form with the CTP Insurer of the at-fault driver. Extensions may be permitted if there is a reasonable excuse for the delay.
If the at-fault motor vehicle is either unregistered or unidentified, you can still bring a claim but strict rules and time limits apply. You can make a claim against the Nominal Defendant, and a state government fund will act as the CTP Insurer of the at-fault vehicle. A compliant claim form must be delivered to the Nominal Defendant within three (3) months from the date of the motor vehicle accident, failing which a claim may only proceed upon providing the Nominal Defendant with an explanation for the delay. Where the at-fault vehicle is unidentified, failure to deliver a compliant claim form to the Nominal Defendant within nine (9) months from the date of the accident will preclude a motor vehicle accident claim against the Nominal Defendant.
You have only 3 years from the date of the car accident within which to commence court proceedings failing which any claim you would have otherwise been entitled to bring will be forever statute-barred.
