The trouble is that the law in this area is quite complex and can be difficult to negotiate successfully without specific knowledge and experience. One wrong turn in this area of law can be fatal to your claim for workers' compensation benefits and also for a claim for damages against your employer. When someone has suffered an injury at work, there are many things that they need to know to ensure they receive all of the entitlements provided for them in the legislation. If this is you, there are many things which you should do and equally many things that you should not do to ensure you receive your maximum entitlements. We ensure that each of our clients get the advice they need and take all of the steps necessary to protect their interests.
Where an injury has occurred as a result of an unsafe workplace accident, you may have the right to make a workers' compensation claim for benefits (“statutory benefits”) and/or bring a common law claim (damages).
To successfully claim statutory benefits, you will need to establish that you are a worker and have suffered an injury as defined in the legislation and that your employment was a significant contributing factor to your suffering the injury.
You have only 20 business days to lodge an appeal to the Industrial Relations Commission
If your application for statutory benefits is rejected, you have only 3 months to make an application to the regulator for a review of the decision. If your application for review is unsuccessful, you have only 20 business days to lodge an appeal to the Industrial Relations Commission. These time limits are strict and by and large cannot be overcome if they are missed.
If you are successful in applying for statutory benefits, you are entitled at the end of the claim to receive a Notice of Assessment (NOA).
The NOA will set out the Degree of Permanent Impairment (DPI) attributed to the injury and will set out a corresponding offer of lump sum compensation.
The worker will have only 20 business days to advise the workers' compensation insurer that they disagree with the DPI. Failure to challenge the DPI in that time frame will cause the DPI as assessed to remain. Should the DPI be assessed at less than 20% and the worker accept the corresponding offer of lump sum compensation, lost forever is the right or entitlement for the worker to pursue common law damages.
